Version 1.0 · 4 October 2026
Article 1. Definitions
In these terms and conditions:
- Supplier means tInteractive Media Solutions, based in Heiloo, the Netherlands, Chamber of Commerce (KvK) number 42121582, which offers Selevy.
- Customer means the club or other legal entity that enters into an agreement with the supplier.
- Selevy or the service means the online software for following and assessing players and selecting teams, which the supplier makes available over the internet (software as a service).
- User means anyone who has access to Selevy on behalf of the customer, such as board members, members of the technical committee, coaches and trainers.
- Player means a person listed as a player in the customer's Selevy who is not archived, whether or not that person is in a team or has been evaluated. Staff and users are not players within the meaning of these terms and conditions.
- Selevy AI means the optional AI features of Selevy, such as summaries and a draft team selection.
- Agreement means the arrangement between supplier and customer on the use of Selevy, including these terms and conditions and the data processing agreement.
- Contract year means a period of twelve months, counted from the start date (Article 3.5).
Article 2. Applicability
- These terms and conditions apply to every offer of the supplier and to every agreement concerning Selevy.
- The customer's general terms and conditions do not apply.
- The data processing agreement forms part of the agreement. In the event of a conflict concerning personal data, the data processing agreement prevails.
- If a provision is invalid, the other provisions remain in force. The parties then replace the invalid provision with a valid provision that comes as close as possible to its intention.
Article 3. Formation of the agreement
- The customer signs up through the sign-up form on selevy.nl or selevy.com, or in another way offered by the supplier. In doing so, the customer states the desired number of players and whether Selevy AI is included.
- The agreement is formed as soon as the supplier has confirmed the sign-up by email.
- The person signing up declares that they are authorised to represent the customer.
- The supplier may refuse a sign-up, for example if the details appear to be incomplete or incorrect.
- The first contract year begins on the start date: the day on which the supplier has set up Selevy for the customer and the customer has access, but no later than 30 days after the agreement was formed. The invoice for the first contract year follows after the start date.
Article 4. The service
- The supplier makes Selevy available with the features described on the website at the time of signing up.
- The number of users is unlimited.
- The supplier may improve and change Selevy. If an essential feature that the customer uses is removed, the supplier gives at least two months' notice, and the customer may terminate the agreement as of that date, with a refund of the amount paid in advance for the remaining period.
- The supplier helps the customer by email with questions about using Selevy, on working days and within a reasonable time.
Article 5. Demo
- A demo is free of charge, without obligation and temporary. After 7 days the demo is deleted automatically, together with all data in it.
- A demo is meant for trying Selevy with fictional data. The customer does not put real personal data of members into a demo. The demo has limitations, among other things for import, email and Selevy AI.
- No availability guarantees apply to a demo. Data from a demo is not transferred to a paid subscription.
Article 6. Prices and payment
- The price consists of a fixed amount per contract year plus an amount per player, with an optional supplement per player for Selevy AI. The amounts are shown on the website and in the confirmation of the sign-up. All amounts exclude VAT.
- The supplier invoices once per contract year, in advance. The first contract year based on the number of players stated by the customer when signing up. At each renewal based on the number of players at the time the supplier prepares the invoice for the new contract year (about one month before the renewal date), rounded up to a multiple of 25 and at least 25. That number then counts as the stated number for the new contract year.
- If, during a contract year, the customer follows more players than stated for longer than 14 days, the supplier automatically increases the number to the smallest multiple of 25 that fits all players, for the rest of the contract year. The supplier invoices the difference pro rata for the remaining months of the contract year, where the month in which the number was exceeded counts as a whole month: (additional players × price per player, including any supplement for Selevy AI) × remaining months / 12.
- If the customer follows fewer players than stated, the difference is not refunded. At renewal the number is adjusted in accordance with paragraph 2.
- Selevy AI can be switched on at any time; the supplement is then invoiced pro rata as in paragraph 3. If the customer switches Selevy AI off, this takes effect from the next renewal.
- The payment term is 30 days from the invoice date.
- If the customer does not pay on time, the supplier sends a reminder with a new term of 14 days. If payment has still not been made after that, the supplier may suspend access to Selevy until payment is made. The customer's data is kept during that period.
- The supplier may adjust the prices once a year, as of the renewal date. The supplier gives at least two months' notice of this. If the customer does not agree, the customer may terminate the agreement as of the renewal date.
Article 7. Term and termination
- The agreement runs for one contract year and is then tacitly renewed each time for one contract year.
- Either party may terminate the agreement as of the end of a contract year, with one month's notice. Notice may be given by email.
- Either party may end the agreement with immediate effect if the other party seriously fails to perform and does not remedy this after a written notice of default with a reasonable term, or if the other party goes bankrupt or ceases to exist.
Article 8. Fair use of Selevy AI
- Selevy AI is included for normal use by the club (fair use). A monthly limit per club applies.
- When the customer approaches the limit, the customer sees a warning. Once the limit has been reached, the AI features are unavailable until the end of the month. The rest of Selevy keeps working as usual.
- In the case of structurally very high use, the supplier contacts the customer to find a suitable solution.
- AI output is an aid and may be incorrect or incomplete. The customer remains responsible for decisions about players and teams.
Article 9. Obligations of the customer
- The customer ensures that users keep their login details secret, and revokes access for users who are no longer involved with the club.
- The customer is responsible for the data put into Selevy and ensures that there is a valid legal basis for it. The customer informs players and parents about the use of Selevy.
- The customer does not use Selevy in breach of the law or of these terms and conditions, and does not attempt to circumvent the security or disrupt the service.
Article 10. Availability and maintenance
- The supplier makes every effort to keep Selevy available as well as possible, but does not guarantee uninterrupted availability.
- The supplier carries out planned maintenance as far as possible outside the times when clubs use Selevy a lot, and announces it in advance if the interruption is expected to last longer than one hour.
- The supplier automatically makes a backup of the customer's data every day.
Article 11. Personal data
- When Selevy is used, the supplier processes personal data on behalf of the customer. The customer is the controller and the supplier is the processor.
- The arrangements on this are set out in the data processing agreement, which forms part of the agreement.
Article 12. End of the agreement: data
- After the end of the agreement, the customer's administrators can still log in for 30 days to view their data and export it themselves. Changes are no longer possible during that period; other users and parents no longer have access.
- No later than 60 days after the end of the agreement, the supplier deletes the customer's data, unless the law requires it to be kept longer. Backups are kept for 3 months; data therefore also disappears from the backups no later than 3 months after deletion.
Article 13. Intellectual property
- All rights to Selevy, such as the software, the design and the documentation, remain with the supplier. The customer receives a non-exclusive, non-transferable right to use Selevy during the term of the agreement.
- The data the customer puts into Selevy remains the customer's.
- The supplier may only use the customer's name and logo as a reference if the customer gives permission.
Article 14. Liability
- The supplier's liability is limited to compensation for direct damage, up to at most the amount the customer paid for Selevy in the twelve months before the event that caused the damage.
- The supplier is not liable for indirect damage, such as consequential damage, loss of profit and damage due to business interruption, nor for damage resulting from decisions the customer makes on the basis of Selevy or Selevy AI.
- These limitations do not apply in the event of intent or deliberate recklessness on the part of the supplier.
- Damage must be reported in writing as soon as possible, and no later than three months after its discovery.
Article 15. Force majeure
- A party is not required to perform its obligations in the event of force majeure. Force majeure also includes a failure at a supplier, such as the hosting provider or an AI service, or a failure of the internet or electricity beyond the supplier's control.
- If the force majeure lasts longer than 60 days, either party may end the agreement in writing. What has already been performed is settled proportionately.
Article 16. Changes to these terms and conditions
- The supplier may change these terms and conditions. The supplier announces a change at least one month before it takes effect.
- If a change is materially disadvantageous to the customer, the customer may terminate the agreement as of the date on which the change takes effect.
Article 17. Applicable law and disputes
- The agreement is governed by Dutch law.
- Disputes are submitted to the competent court in the district of North Holland (Noord-Holland), unless the law designates another court. The parties first try to resolve a dispute together.
- These terms and conditions are also available in Dutch. In the event of differences between the Dutch and the English text, the Dutch text prevails.
